Conditions of Use and Occupancy
The following policies are a tenant's guide to house rules, operation and maintenance requirements on the rental accommodation you occupy.
- Rent Due: rent is due on the first day of each month, payable to Duane Pauley at 5 Bridge Street Sackville N.B. E4L 3N6. Post dated cheques are the most convenient method of prompt payment.
- Rent Past Due: rent past due more than five days may result in issuance of notice to vacate.
- NSF Cheques: cheques not honored by the bank will be charged back to the tenant with a handling fee of $50.
- Locks: additional locks may not be installed without consent of owner/management. We must have a key for any additional locks installed.
- Locked out: a lock out fee of $50 will be charged after business hours to provide keys to access your apartment or home because yours are lost, misplaced, locked inside, or otherwise not available to you when you need them. Business hours are 8:30 am to 5:00 pm during all working days of the year. The afterhours fee will be charged evenings, weekends, and holidays, and is payable on the spot. During office hours, you may pick up the necessary keys and return them to us the same day without charge.
- Insurance: the owner does not carry insurance to cover liability for your actions or your personal property if damaged. Theft or disturbance by neighbors or other persons is your problem and you may call the police. If the problem is caused by a neighbor renting through this office, we will enforce the policies stated herein. Management will not be responsible for any personal items stolen from a tenant, occupant, or guest of the tenant, whether stolen from the apartment or any other part of the building or personal automobiles.
- Responsible actions: when the premises are occupied by more than one person, all occupants are jointly responsible for the actions of anyone on the premises, whether the occupant is present or not. All persons residing in the apartment will be named in the rental agreement.
- Town Bi-Laws: All tenants must abide be the town Bi-Laws. Any and all violations of the bi-laws that result in a fine are the sole responsibility of the tenant(s). Failure to do so will result in a notice to vacate.
- Stereo/TV: stereos and televisions are to be kept at a reasonable volume so as not to disturb others. If they can be heard outside your apartment, the sound is too loud. Subwoofers or bass amplifiers are not permitted. Loud parties or large groups of people at your apartment will not be tolerated.
- Counter tops: please use a cutting board and heat protectors on the counter tops to prevent damage.
- Windows: do not remove window screens or use windows as an entrance to your apartment. Replacement of broken windows and damaged screens is the responsibility of the tenant, even if the cause is accidental.
- Walls: walls are washable with care. Use a clean cloth and a mild detergent.
- Plumbing: if the drainage plumbing exclusively serving your apartment becomes blocked due to an object originating from your apartment, it shall be the responsibility of the tenant to pay for charges to clear the blockage
- Appliances: appliances provided with the apartment are to be kept clean, with no parts removed. At vacancy, they must be spotlessly cleaned with an appropriate cleaner (i.e. No steel wool used on ceramic stove top or the faces of appliances). Stoves and range hoods must be cleaned of baked on grease and food. Refrigerators must be empty and frost-free.
- Snow removal: the owner will arrange snow clearing of common parking areas and common walkways. If you have a private walk, doorstep, or entry, you are responsible for shoveling after each snowfall. Walking surfaces should be kept bare for safety and to prevent doors from icing so they do not close. Occasional use of ice salt may be necessary.
- Garbage: garbage must be bagged and removed from your apartment weekly. Recyclable and refundable items should be removed at minimum monthly. Municipal garbage pickup is done weekly at curb side or from a designated collection bin or building.
- Smoking: smoking is strictly Not Permitted inside the apartments. Failure to comply will result in a notice to vacate and a charge to repaint the entire apartment.
- Pets: no pets are permitted without notice to and consent from the owner/manager. If permission is granted, a special “pet clause” will be added to your lease. The special obligations of the pet clause will be determined at the time of request, depending on the type of pet and your accommodations.
- Collective Leasing: Each and every person who signs this lease is responsible for the full payment and all conditions held within this lease.

- Obligations at Vacancy: following notice to vacate from the tenant, there are minimum standards of cleaning, repair, and wear and tear which the tenant must meet. A schedule of “Obligations at Vacancy” will be provided when notice to vacate is received.
- Tenancies Act: All of the terms and conditions of the standard form of lease #6 are governed by the Residential Tenancies Act of New Brunswick, 1975, and its amendments. Management reserves the right to make such other rules and regulations from time to time as may be deemed necessary for the safety and convenience of all tenants. It is the responsibility of the tenant to thoroughly read the rental agreement and attached regulations.
- Light Bulbs: Tenant(s) are responsible for maintaining light bulbs within their apartment.
- Notice of Change: any of the preceding items may be changed by the owner/management with appropriate written notice.
- Parties: Absolutely no parties or groups more than 10 people.
